Welcome to Booty Hunters! Digital, a fantasy naval combat game and related service operated by Piratical Productions LLC (“Piratical Productions,” “we,” “us,” or “our”).
These Terms of Service (“Terms”) govern your access to and use of Booty Hunters! Digital, including the game available through frogdapirate.com, the Booty Hunters! Digital Discord Activity, multiplayer services, online features, and related digital services we provide collectively as the “Service.”
By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be legally permitted to use the Service.
When accessing Booty Hunters! Digital through Discord, you must also satisfy Discord’s eligibility and age requirements and comply with Discord’s applicable terms and policies.
If you are a minor where you live, you should use the Service only with the permission of a parent or legal guardian when required by law.
2. Accounts
Some features may require a WordPress, Discord, or other supported account.
You are responsible for maintaining the security of your accounts and credentials and for activity conducted through your accounts.
You may not impersonate another person, gain unauthorized access to another user’s account, or attempt to bypass access controls, subscriptions, entitlements, purchase requirements, or other security systems.
3. License to Use Booty Hunters! Digital
Subject to these Terms, Piratical Productions LLC grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use Booty Hunters! Digital for its intended entertainment purposes.
You may not, except where permitted by applicable law:
- copy, redistribute, sell, sublicense, or commercially exploit the Service or its assets without permission;
- reverse engineer or attempt to circumvent security or access-control systems;
- use cheats, exploits, automation, malicious software, or unauthorized modifications that interfere with gameplay or other users;
- use the Service to attack, disrupt, overload, or gain unauthorized access to our systems or another person’s systems.
4. Game Rules and Fair Play
Booty Hunters! Digital is a competitive and cooperative game. Players are expected to participate in good faith.
Game mechanics, factions, ships, abilities, balance, artificial intelligence, rules, maps, rewards, and other features may be changed as the game develops.
During Early Access, features may be incomplete, experimental, changed, temporarily disabled, reset, or removed.
We may take reasonable steps to address cheating, exploits, harassment, abuse, or conduct that interferes with the Service or other players.
5. Multiplayer and Discord Activities
Booty Hunters! Digital may allow users to host, join, spectate, or participate in multiplayer voyages.
You are responsible for the people with whom you choose to share private voyage codes, invitations, or other access information.
Use of the Discord Activity is also subject to Discord’s own terms, rules, community standards, and platform requirements.
Discord is a third-party platform and is not owned or operated by Piratical Productions LLC.
6. Purchases, Subscriptions, and Premium Features
Booty Hunters! Digital may offer paid subscriptions, individual content unlocks, premium features, downloadable products, or other purchases.
Prices, subscription periods, free trials, available products, and included features will be disclosed before purchase and may change for future purchases.
Where recurring subscriptions are offered, they continue according to the terms presented during checkout until canceled.
Purchases made through a third-party platform or payment provider are also subject to that provider’s payment terms.
For purchases made through Discord Premium Apps, Discord may process the checkout, billing, receipts, and related payment functions, while Booty Hunters! Digital uses Discord entitlements to determine access to purchased features.
7. Refunds
Refund eligibility may depend on where and how you made your purchase.
Purchases made through Discord, payment processors, app stores, or other third-party platforms may be governed by that platform’s refund procedures in addition to applicable law.
Nothing in these Terms limits any refund, cancellation, or consumer rights that cannot legally be waived.
8. Pirate Codes, Promotional Access, and Trials
We may provide promotional codes, free-game codes, trial access, testing access, promotional entitlements, or similar benefits.
Promotional offers may have limits including expiration dates, account restrictions, redemption limits, cooldown periods, or usage requirements.
Promotional access has no cash value and may not be sold, transferred, duplicated, or abused unless we expressly permit it.
We may revoke promotional access obtained through fraud, exploitation, unauthorized duplication, or technical abuse.
9. Intellectual Property
Booty Hunters!, Booty Hunters! Digital, associated game rules, characters, factions, ships, artwork, logos, written content, software, audiovisual materials, and other original materials are owned by or licensed to Piratical Productions LLC and are protected by applicable intellectual-property laws.
Nothing in these Terms transfers ownership of our intellectual property to you.
Third-party trademarks, platforms, and services remain the property of their respective owners.
10. Feedback
If you voluntarily provide suggestions, bug reports, gameplay ideas, balance feedback, or other feedback concerning the Service, you permit us to use that feedback to develop, improve, market, or modify Booty Hunters! Digital without an obligation to compensate you.
You retain ownership of any intellectual property that you independently owned before providing feedback.
11. Acceptable Conduct
You may not use the Service to engage in unlawful activity, harassment, threats, fraud, malicious interference, exploitation of security vulnerabilities, or conduct intended to harm other users or the Service.
You may not intentionally interfere with multiplayer games, manipulate systems outside normal gameplay, or attempt to obtain paid content through unauthorized means.
12. Suspension and Termination
We may restrict, suspend, or terminate access to the Service when reasonably necessary to protect users, enforce these Terms, comply with law, address fraud or abuse, or protect the Service.
You may stop using the Service at any time.
Termination does not eliminate rights or obligations that by their nature should survive termination, including intellectual-property protections and limitations of liability.
13. Service Availability and Early Access
Booty Hunters! Digital is under active development.
We do not guarantee that the Service will always be available, uninterrupted, error-free, or compatible with every device, browser, Discord client, operating system, or third-party service.
Maintenance, updates, technical failures, security issues, platform changes, or other circumstances may temporarily affect availability.
We may modify, update, replace, or discontinue features when reasonably necessary.
14. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available.”
Piratical Productions LLC disclaims warranties that may legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Piratical Productions LLC and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Service.
Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by applicable law.
Nothing in these Terms excludes liability that cannot legally be excluded.
16. Third-Party Services
The Service may interact with third-party services including Discord, WordPress, WooCommerce, payment processors, hosting providers, and other technology services.
We do not control those third-party services and are not responsible for changes, outages, policies, or actions of those providers.
Your use of a third-party service remains subject to that provider’s terms and policies.

18. Changes to These Terms
We may update these Terms as Booty Hunters! Digital develops, our business changes, or legal and platform requirements change.
When we make material changes, we will update the “Last Updated” date and may provide additional notice when appropriate.
Continued use of the Service after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by law.
19. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, except where applicable consumer law requires otherwise.
Nothing in these Terms deprives consumers of mandatory protections provided by the laws of their jurisdiction.
